EVALUATING THE LEGAL SYSTEM

This program looks at the evaluation of our legal system. It poses four key questions to assess its on-going effectiveness and relevance.

They are: is a fair hearing ensured; is effective access to the legal system provided; is dispute resolution timely; and are social values and human rights reflected in the workings of our legal system? Each question is examined in turn, with various case studies from a number of states and courts in Australia illustrating some of the limitations on our legal system.

Case studies referred to include: Vernon Moran assaulted by police in NSW; Leesa Meldrum's fight with Victorian IVF legislation; Lindy Chamberlain's murder trial, imprisonment and release; tribal law in Barnes versus the Queen in the Northern Territory; a 55 year sentence imposed on a gang rapist in NSW; Frank Button's rape conviction, appeal and overturning of the decision in Queensland. In the latter case study, all four questions are applied. The program's presenter takes viewers through the four questions, raising a number of points on the way, and the case studies, with ABC footage and reports providing the background.

Note: Available in Australia only.

FIRST TIME VOTERS

The 2007 Federal election was a watershed moment in Australian politics; a fresh-faced but inexperienced leader faced a battle-hardened veteran whose ideas, many said, felt stale. With the youth vote targeted like never before, this program captured the thoughts, hopes and aspirations of five young people as they voted for the first time. Roxxy, Fin, Ben, Ella and Chris shared with us their thoughts on democracy, compulsory voting, Australia's parliamentary system and how they would decide who to vote for via the policies, personalities and media influence. This engaging program is fascinating reflection on the decision-making process and political engagement of this complex generation.

Australia's governance and law making system is the bedrock of our society. Fairness, equality and justice are the pillars on which our thriving, complex modern life is based. But how did we arrive at this enviable situation? And how does our system actually work on different levels? This informative program gives a fantastic overview of the role of the Commonwealth Constitution in establishing the Federal parliament and the way powers are divided. We examine our three levels of government, how they work together and separately to create laws, and the structure and role of the Australian parliamentary system. Following a step-by-step passage of a bill through both houses of parliament at a federal and state level, it is a practical and clear explanation of this most important legal function. It also illustrates why and how local governments create law.
